Restricting Public Marijuana Smoking

Contrary to published reports, the Board of Trustees (BOT) is not looking to outlaw marijuana.  They are, however, responding to a request from the Police Department to strengthen the law so the police can enforce it.

 

After a short discussion at the May 11, 2026 Work Session of the BOT, it was decided to incorporate smoking (or vaping) cannabis into the current statute regarding smoking of tobacco and other substances in public places.  The BOT equated this action with restricting open containers and prohibiting public drinking.

 

The Village Attorney affirmed the Village’s authority to limit “time, place and manner” for the use of such products.  He was asked to draft changes to the current code to be available for the next Work Session on May 26th where the public may comment.
